This Privacy Policy is incorporated by reference into our Terms of Service ("ToS") and, for our business customers, the Master Subscription Agreement ("MSA").
By accessing the Website or using the Service, you agree to the information collection and use practices described in this Privacy Policy. If you do not agree, please do not use the Website or the Service.
2. Information We Collect
We collect various types of information in connection with the Service:
2.1. Information You Provide Directly

- User Content: We collect the information, data, text, communications, and other materials you upload, post, or transmit to the Service ("User Content"). This may include financial data, sales data, inventory data, and conversations within the Service.
- Communications: If you contact us directly (e.g., for support or inquiries), we may receive additional information about you, such as the content of your messages.
- AI Information: We collect the inputs (prompts) you provide to the AI Assistant and the outputs (AI Output) generated.
2.2. Information Collected Automatically
- Usage and Log Data: When you use the Service, we automatically collect information about your access and use, such as your IP address, browser type, operating system, pages visited, dates and times of access, and device identifiers ("Usage Data").
- Cookies and Similar Technologies: We use cookies and similar technologies (e.g., web beacons) to collect information about your interaction with the Website and Service, remember your preferences, and improve your experience. You can control the use of cookies at the browser level.
3. How We Use Your Information
We use the information we collect for various purposes, including:

- Communicating with You: To respond to your comments and questions, provide customer support, and send you service-related information (e.g., updates, security alerts, administrative messages).
- Marketing (with Opt-Out): To send you promotional emails about new products or features, subject to your right to opt-out of receiving such communications. We do not use your confidential User Content for marketing.
- Security and Fraud Prevention: To detect and prevent fraud, abuse, violations of our terms (including the AUP), and other harmful activities.
- Legal Compliance: To comply with our legal obligations, resolve disputes, and enforce our agreements.
- AI Data Usage: We use AI inputs and outputs (in anonymized or aggregated form where feasible) primarily for abuse and security monitoring (as detailed in the AI Terms) and potentially to improve specific AI functionality (e.g., enhancing safety filters), but not for training general-purpose AI models.
4. How We Share Your Information
We do not sell your personal information. We may share your information in the following limited circumstances:
- Service Providers (Sub-processors): We share information with third-party vendors who help us operate the Service, such as cloud hosting providers (e.g., AWS), AI providers (e.g., Google), payment processors, and analytics tools. These providers are authorized to use your information only as necessary to provide services to us and are bound by confidentiality obligations. A list of key sub-processors is available in our DPA.
- Legal Compliance and Protection: We may disclose your information if we believe in good faith that it is necessary to (a) comply with a legal obligation, subpoena, or court order; (b) protect and defend the rights or property of BIGWISE; (c) prevent or investigate possible wrongdoing in connection with the Service; (d) protect the personal safety of users or the public; or (e) protect against legal liability.
- Business Transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or other sale of all or a portion of our assets, your information may be transferred as part of that transaction.
- With Your Consent: We may share your information with third parties if you give us your explicit consent to do so.
5. Data Security
We implement technical and organizational security measures designed to protect your personal information against unauthorized access, use, alteration, or disclosure. However, no security system is impenetrable, and we cannot guarantee the absolute security of your information.
6. Data Retention
We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, including providing the Service, complying with our legal obligations, resolving disputes, and enforcing our agreements. Specific retention periods may vary depending on the type of information and legal requirements. Retention of AI data is governed by the AI Terms. Retention of business customer data post-termination is governed by the MSA.
